AN ACT
1 Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2 Statutes, in weights and measures, further providing for
3 meter required.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 4180(a) of Title 3 of the Pennsylvania
7 Consolidated Statutes is amended and the section is amended by
8 adding a subsection to read:
9 ยง 4180. Meter required.
10 (a) Metered vehicle.--No person shall deliver light fuel
11 oils to any domestic consumer unless the vehicle by which such
12 light fuel oils are delivered is equipped with a meter of a type
13 capable of furnishing a printed delivery ticket approved under
14 provisions of Subchapter D (relating to device type approval).
15 Each meter-printed delivery ticket shall bear a printed
16 nonrepetitive serial number. All deliveries of light fuel oil to
17 [such] domestic consumers shall be made by the use of a meter
18 and a meter-printed delivery ticket rendered the [customer]
1 domestic consumer at the time of delivery or with the invoice.
2 For meters equipped with the capability of issuing an electronic
3 receipt, ticket or other recorded representation, the domestic
4 consumer may be given the option to receive the meter-printed
5 delivery ticket electronically in lieu of or in addition to a
6 printed delivery ticket. A seller or deliverer may not impose a
7 separate fee for domestic consumers to accept or receive a
8 delivery ticket by any method, including a meter-printed
9 delivery ticket or electronic version of the meter-printed
10 delivery ticket. The seller or deliverer shall maintain the
11 receipts for two years in an orderly and retrievable manner.

13 (c) Electronic delivery ticket.--
14 (1) An electronic delivery ticket may only be provided
15 to the domestic consumer if agreed to by the domestic
16 consumer and if the technology is available to the deliverer
17 of light fuel oils.
18 (2) The electronic delivery ticket shall contain all
19 information required under subsection (b).
20 Section 2. This act shall take effect immediately.
