AN ACT
1 Amending Title 66 (Public Utilities) of the Pennsylvania
2 Consolidated Statutes, in rates and distribution systems,
3 further providing for valuation of acquired water and
4 wastewater systems.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 1329(c) of Title 66 of the Pennsylvania
8 Consolidated Statutes is amended by adding paragraphs to read:
9 § 1329. Valuation of acquired water and wastewater systems.

11 (c) Ratemaking rate base.--The following apply:

13 (3) The depreciated original cost of the acquired system
14 as calculated under subsection (d)(5) may be incorporated <--
15 into MAY BE INCORPORATED INTO THE ratemaking rate base as <--
16 soon as the first base rate case post-closing or in the
 1 entity's initial tariff filing.
2 (4) The difference between the depreciated original
3 cost calculated under subsection (d)(5) and the ratemaking <--
4 rate base of the selling utility as determined under
5 paragraph (2) shall be incorporated into the rate base of the
6 acquiring public utility equally over the three base rate
7 cases after closing or in the entity's first three base rate
8 cases after its initial tariff filing.

10 Section 2. This act shall take effect in 60 days.
