AN ACT
1 Amending Title 58 (Oil and Gas) of the Pennsylvania Consolidated
2 Statutes, in development, further providing for well permits.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Section 3211 of Title 58 of the Pennsylvania
6 Consolidated Statutes is amended by adding a subsection to read:
7 § 3211. Well permits.

9 (a.1) Oil and gas fluid injection wells prohibited.--No
10 person shall drill or alter a well to inject fluids produced in
11 association with oil and gas production for disposal or storage.
12 The department may not issue a well permit for a proposed
13 drilling or alteration of a well to inject fluids produced in
14 association with oil and gas production for disposal or storage.
15 A person who resides or owns property within five miles of a
16 well drilled or altered in violation of this subsection and a
17 person who owns or operates a business that conducts business
18 activities within five miles of a well drilled or altered in
1 violation of this subsection may bring an action in a court of
2 common pleas to enforce compliance with this subsection. In an
3 action brought under this subsection, the court of common pleas
4 may grant appropriate relief, including actual damages, attorney
5 fees and court costs and equitable and injunctive relief. An
6 action under this subsection shall be brought in the court of
7 common pleas in the district where the well is located.

9 Section 2. This act shall take effect in 60 days.
