A RESOLUTION
1 Urging the Congress of the United States and the United States
2 Environmental Protection Agency to take action and end
3 regulations relating to vehicle emissions testing.
4 WHEREAS, The Congress of the United States enacted the Clean
5 Air Act in 1970, which authorized the United States
6 Environmental Protection Agency (EPA) to establish the National
7 Ambient Air Quality Standards to protect public health and
8 welfare and to regulate emissions of hazardous air pollutants;
9 and
10 WHEREAS, Federal and state regulations have been promulgated
11 under the Clean Air Act to limit emissions and regulate air
12 pollution; and
13 WHEREAS, The EPA works with its Federal, state and tribal
14 regulatory partners through a comprehensive clean air compliance
15 monitoring program to ensure that regulated communities obey
16 environmental laws and regulations through inspections and tools
17 to help meet environmental regulatory requirements; and
18 WHEREAS, In October 1995, the Commonwealth announced
1 Pennsylvania's emissions inspection program that was designed to
2 meet this Commonwealth's regional clean air goals; and
3 WHEREAS, By June 2004, 25 counties implemented a vehicle
4 emission testing program, bringing this Commonwealth into
5 compliance with the Clean Air Act; and
6 WHEREAS, Electric vehicles and diesel-powered vehicles are
7 federally exempt from the Vehicle Emissions Inspection and
8 Maintenance Program; and
9 WHEREAS, Vehicle emissions tests are no longer effective at
10 reducing air pollution due to new, fuel-efficient vehicles and a
11 heightened focus and promised manufacturing support on fuel-
12 efficient vehicles; therefore be it
13 RESOLVED, That the House of Representatives of the
14 Commonwealth of Pennsylvania urge the Congress of the United
15 States and the United States Environmental Protection Agency to
16 take action and end regulations relating to vehicle emissions
17 testing; and be it further
18 RESOLVED, That the House of Representatives of the
19 Commonwealth of Pennsylvania urge the Governor to petition the
20 Congress of the United States, the United States Department of
21 Transportation and the United States Environmental Protection
22 Agency to consider legislation or regulations that would end
23 emissions testing and eliminate unnecessary barriers that are
24 being inflicted upon residents of this Commonwealth; and be it
25 further
26 RESOLVED, That copies of this resolution be transmitted to
27 the President of the United States, the Vice President of the
28 United States, the United States Secretary of Energy, the
29 presiding officers of Congress, the chair and ranking member of
30 the Senate Committee on Commerce, Science and Transportation,

1 the chair and ranking member of the Senate Committee on
2 Environment and Public Works, the chair and ranking member of
3 the House Committee on Energy and Commerce, the chair and
4 ranking member of the House Committee on Transportation and
5 Infrastructure, each member of Congress from Pennsylvania and to
6 the Governor.
