AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in intermediate units, further
6 providing for powers and duties of the intermediate unit
7 board of directors and, for capital subsidy. AND FOR SCHOOL <--
8 SAFETY AND SECURITY ENHANCEMENTS; AND, IN SCHOOL SAFETY AND
9 SECURITY, FURTHER PROVIDING FOR TARGETED SCHOOL SAFETY GRANTS
10 FOR NONPUBLIC SCHOOLS AND SCHOOL ENTITIES PROGRAM.
11 The General Assembly of the Commonwealth of Pennsylvania
12 hereby enacts as follows:
13 Section 1. Sections 914-A(11) and 919.1-A(a) of the act of
14 March 10, 1949 (P.L.30, No.14), known as the Public School Code
15 of 1949, are amended to read:
16 Section 914-A. Powers and Duties of the Intermediate Unit
17 Board of Directors.--An intermediate unit board of directors
18 shall have the power and its duty shall be:

20 (11) To [lease] acquire land and buildings by purchase,
1 lease or gift and to own office space and warehouse facilities.
2 * * *
3 Section 919.1-A. Capital Subsidy.--(a) All lease
4 agreements, security agreements, loan agreements, mortgages or
5 any other contracts, instruments or agreements for office space,
6 classrooms, warehouse space and [similar] other facilities shall
7 be pre-approved by the Secretary of Education. [Loan agreements
8 and mortgages for office and warehouse facilities shall be pre-
9 approved by the Secretary of Education.] For the 1977-1978
10 school year and each school year thereafter, in addition to any
11 payments required under section 917.1-A, the Commonwealth shall
12 allocate to the intermediate units, on account of approved lease
13 agreements, loan agreements, mortgages, security agreements or
14 any other contracts, instruments or agreements, an amount to be
15 determined as follows: by obtaining the product of the number of
16 students in average daily membership (ADM) multiplied by the
17 median actual instruction expense per weighted average daily
18 membership of all the school districts, to be further multiplied
19 by three one-hundredths of one percent (0.03%), based on the
20 latest actual data available to the Secretary of Education.

22 SECTION 2. SECTION 923.3-A(C) AND (D) OF THE ACT, AMENDED <--
23 DECEMBER 13, 2023 (P.L.187, NO.33), ARE AMENDED AND SUBSECTION
24 (B) IS AMENDED BY ADDING A DEFINITION TO READ:
25 SECTION 923.3-A. SCHOOL SAFETY AND SECURITY ENHANCEMENTS.-*

27 (B) DEFINITIONS. AS USED IN THIS SECTION:
28 "COMMISSION" MEANS THE PENNSYLVANIA COMMISSION ON CRIME AND
29 DELINQUENCY.

1 (C) PROGRAM OF SCHOOL SAFETY AND SECURITY ENHANCEMENTS. A
2 PROGRAM OF SCHOOL SECURITY ENHANCEMENTS SHALL BE PROVIDED [BY AN
3 INTERMEDIATE UNIT IN WHICH A NONPUBLIC SCHOOL IS LOCATED,] FOR
4 NONPUBLIC SCHOOLS IN ACCORDANCE WITH STANDARDS DEVELOPED BY THE
5 SCHOOL SAFETY AND SECURITY COMMITTEE ESTABLISHED UNDER SECTION
6 1302-B IN CONSULTATION WITH THE DEPARTMENT OF EDUCATION AND
7 PURSUANT TO SECTION 1306.1-B. [THROUGH THE PROGRAM, AN
8 INTERMEDIATE UNIT SHALL MAKE APPLICATION FOR SCHOOL SAFETY AND
9 SECURITY ENHANCEMENTS UPON THE REQUEST OF A NONPUBLIC SCHOOL OR
10 COMBINATION OF NONPUBLIC SCHOOLS LOCATED WITHIN THE INTERMEDIATE
11 UNIT. SCHOOL SAFETY AND SECURITY ENHANCEMENTS FOR WHICH GRANTS
12 ARE RECEIVED SHALL BE PROVIDED FOR OR CONTRACTED FOR DIRECTLY BY
13 THE INTERMEDIATE UNIT OR LOANED BY THE INTERMEDIATE UNIT TO THE
14 NONPUBLIC SCHOOL.]
15 (D) LIMITATIONS. IN CARRYING OUT THE DUTIES OF THIS SECTION
16 AND THE SCHOOL SAFETY AND SECURITY GRANT PROGRAM, THE
17 [INTERMEDIATE UNIT] COMMISSION MAY NOT USE MORE THAN FIVE PER
18 CENTUM (5%) OF THE FUNDS IT RECEIVES UNDER THIS SECTION FOR
19 GRANT ADMINISTRATION. [IF ALL FUNDS ALLOCATED BY THE
20 INTERMEDIATE UNITS FOR ADMINISTRATION ARE NOT EXPENDED FOR
21 PURPOSES OF THIS SECTION, THE FUNDS MAY BE USED FOR OTHER
22 PROGRAM COSTS.]
23 SECTION 3. SECTION 1306.1-B(J), (K)(3) AND (L)(3) OF THE
24 ACT, ADDED DECEMBER 13, 2023 (P.L.187, NO.33), ARE AMENDED TO
25 READ:
26 SECTION 1306.1-B. TARGETED SCHOOL SAFETY GRANTS FOR NONPUBLIC
27 SCHOOLS AND SCHOOL ENTITIES PROGRAM.

1 TO FUND PROGRAMS THAT ADDRESS SCHOOL VIOLENCE AND SCHOOL MENTAL
2 HEALTH. ELIGIBLE USES OF THE FUNDS SHALL INCLUDE ANY USE UNDER
3 SECTION 1306-B(J) AND TO FUND PROGRAMS THAT ADDRESS SCHOOL
4 VIOLENCE BY ESTABLISHING OR ENHANCING SCHOOL SECURITY, INCLUDING
5 COSTS ASSOCIATED WITH THE TRAINING AND COMPENSATION OF SCHOOL
6 SECURITY PERSONNEL.
7 (K) OTHER GRANT RECIPIENTS.--

9 (3) A NONPUBLIC SCHOOL MAY APPLY TO THE COMMITTEE FOR
10 GRANT FUNDING UNDER PARAGRAPH (1) TO BE USED FOR THE COSTS
11 ASSOCIATED WITH OBTAINING THE SERVICES OF SCHOOL SECURITY
12 PERSONNEL FROM A LIST OF APPROVED VENDORS CERTIFIED BY THE
13 COMMITTEE. [A GRANT AWARD FOR THIS PURPOSE SHALL BE AWARDED
14 AND PAID DIRECTLY TO THE APPROVED VENDOR WITH WHICH THE
15 NONPUBLIC SCHOOL CONTRACTS FOR SERVICES. A NONPUBLIC SCHOOL
16 MAY NOT APPLY FOR GRANT FUNDING UNDER THIS SUBSECTION FOR ANY
17 PURPOSE OTHER THAN OBTAINING THE SERVICES OF SCHOOL SECURITY
18 PERSONNEL UNDER THIS PARAGRAPH.]
19 (L) OTHER DUTIES.--THE COMMITTEE SHALL HAVE THE FOLLOWING
20 DUTIES AS TO TARGETED GRANTS:

22 (3) FOR FISCAL YEAR 2023-2024 AND EACH FISCAL YEAR
23 THEREAFTER, THE COMBINED AMOUNT OF GRANTS AWARDED TO
24 [INTERMEDIATE UNITS ON BEHALF OF] NONPUBLIC SCHOOLS UNDER
25 SUBSECTION (J) AND GRANTS AWARDED FOR COSTS ASSOCIATED WITH A
26 NONPUBLIC SCHOOL OBTAINING THE SERVICES OF SCHOOL SECURITY
27 PERSONNEL UNDER SUBSECTION (K) SHALL BE NO LESS THAN
28 $14,551,000.
