AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in preliminary provisions, providing
6 for minimum number of days or hours.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 130. Minimum Number of Days or Hours.--(a)
13 Notwithstanding section 520.1 or 1501 or other provision of law
14 to the contrary, beginning in the 2023-2024 school year and
15 continuing each school year thereafter, a school entity shall
16 provide within the school year:
17 (1) a minimum of one hundred eighty (180) days of
18 instruction; or
19 (2) nine hundred (900) hours of instruction at the
20 elementary level or nine hundred ninety (990) hours of
 1 instruction at the secondary level.
2 (b) Nothing in this section shall be construed to supersede
3 or preempt a provision of a collective bargaining agreement
4 entered into between a school employer and an exclusive
5 representative of the employes under the act of July 23, 1970
6 (P.L.563, No.195), known as the "Public Employe Relations Act,"
7 prior to the effective date of this section.
8 (c) As used in this section, the term "school entity" shall
9 mean a school district, intermediate unit or area career and
10 technical school.
11 Section 2. This act shall take effect immediately.
