AN ACT
1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2 "An act providing for and reorganizing the conduct of the
3 executive and administrative work of the Commonwealth by the
4 Executive Department thereof and the administrative
5 departments, boards, commissions, and officers thereof,
6 including the boards of trustees of State Normal Schools, or
7 Teachers Colleges; abolishing, creating, reorganizing or
8 authorizing the reorganization of certain administrative
9 departments, boards, and commissions; defining the powers and
10 duties of the Governor and other executive and administrative
11 officers, and of the several administrative departments,
12 boards, commissions, and officers; fixing the salaries of the
13 Governor, Lieutenant Governor, and certain other executive
14 and administrative officers; providing for the appointment of
15 certain administrative officers, and of all deputies and
16 other assistants and employes in certain departments, boards,
17 and commissions; providing for judicial administration; and
18 prescribing the manner in which the number and compensation
19 of the deputies and all other assistants and employes of
20 certain departments, boards and commissions shall be
21 determined," in organization of departmental administrative
22 boards and commissions and of advisory boards and
23 commissions, further providing for State Planning Board.
24 The General Assembly of the Commonwealth of Pennsylvania
25 hereby enacts as follows:
26 Section 1. Section 451(b)(1) and (2) of the act of April 9,
27 1929 (P.L.177, No.175), known as The Administrative Code of
28 1929, are amended and the subsection is amended by adding
1 paragraphs to read:
2 Section 451. State Planning Board.--* * *
3 (b) (1) The State Planning Board shall consist of [fifteen
4 members to be appointed by the Governor from among the citizens
5 of the State, who during their terms shall hold no other office
6 in the executive branch of State Government to which any salary
7 is attached. In addition to these members, there shall be six ex
8 officio members, the Secretary of Agriculture, the Secretary of
9 Community and Economic Development, the Secretary of
10 Environmental Protection, the Secretary of Conservation and
11 Natural Resources, the Secretary of Public Welfare and the
12 Secretary of Transportation. There shall also be two] the
13 following:
14 (i) Two members appointed by, and who serve at the pleasure
15 of, the President pro tempore of the Senate, neither of whom
16 shall be members of the same political party[, and two].
17 (ii) Two members appointed by, and who serve at the pleasure
18 of, the Speaker of the House of Representatives, neither of whom
19 shall be members of the same political party.
20 (iii) Fifteen members appointed by the Governor from among
21 the residents of this Commonwealth, who during their terms shall
22 hold no other office in the executive branch of State Government
23 to which a salary is attached.
24 (iv) The following ex officio members:
25 (A) The Secretary of Agriculture.
26 (B) The Secretary of Community and Economic Development.
27 (C) The Secretary of Conservation and Natural Resources.
28 (D) The Secretary of Environmental Protection.
29 (E) The Secretary of Human Services.
30 (F) The Secretary of Transportation.

1 (G) The Director of the Pennsylvania Emergency Management
2 Agency.
3 (H) The Executive Director of the Pennsylvania Historical
4 and Museum Commission.
5 (1.1) The terms of office of those members appointed by the
6 Governor under paragraph (1)(iii) shall be for four years and
7 until their successors are appointed and have qualified. In case
8 of a vacancy, the Governor shall make an appointment for the
9 unexpired portion of the term.
10 (1.2) The Governor shall designate the chairman and vice-
11 chairman of the board from among the members of the board, other
12 than the ex officio and legislative members.
13 (2) [Thirteen] Fourteen members of the board shall
14 constitute a quorum.

16 Section 2. This act shall take effect in 60 days.
