AN ACT
1 Amending the act of October 5, 1978 (P.L.1109, No.261), entitled
2 "An act requiring the licensing of practitioners of
3 osteopathic medicine and surgery; regulating their practice;
4 providing for certain funds and penalties for violations and
5 repeals," further providing for definitions; AND ABROGATING <--
6 REGULATIONS.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The definitions of "athletic training services"
10 and "physically active person" in section 2 of the act of
11 October 5, 1978 (P.L.1109, No.261), known as the Osteopathic
12 Medical Practice Act, are amended to read:
13 Section 2. Definitions.
14 The following words and phrases when used in this act shall
15 have, unless the context clearly indicates otherwise, the
16 meanings given to them in this section:

18 "Athletic training services."
19 (1) The management and provision of care of injuries to
1 a physically active person as defined in this act with the
2 direction of a licensed physician. The term includes the
3 rendering of emergency care, development of injury prevention
4 programs and providing appropriate preventative and
5 supporting devices for the physically active person. The term
6 also includes the assessment, management, treatment,
7 rehabilitation and reconditioning of the physically active
8 person whose conditions are within the professional
9 preparation and education of a licensed athletic trainer. The
10 term also includes the use of modalities such as mechanical
11 stimulation, heat, cold, light, air, water, electricity,
12 sound, massage and the use of therapeutic exercises,
13 reconditioning exercise and fitness programs.
14 (2) Athletic training services shall not include
15 [surgery, invasive procedures or prescription of any
16 controlled substance.] any of the following:
17 (i) Surgery.
18 (ii) Prescription of any controlled substance.
19 (iii) Invasive procedures, except that an athletic
20 trainer licensed to practice may, with the direction of a
21 licensed physician, perform the following invasive
22 procedures pursuant to a written protocol:
23 (A) Rectal thermometry.
24 (B) Intramuscular or subcutaneous medication
25 administration injections.
26 (C) Airway adjuncts in conformity with basic
27 life support protocols and instruments.
28 (D) Capillary finger sticks for the purpose of
29 testing blood glucose levels.
30 (E) Nasal plugs.

1 (F) Blister and nail care.
2 (G) Administration of naloxone.
3 (H) Removal of superficial foreign bodies.
4 (I) Any other procedures authorized by the
5 board.
6 (3) Nothing in this definition shall be construed to
7 require a licensed physician to authorize a licensed athletic
8 trainer to perform invasive procedures.

10 "Physically active person." An individual who [participates <--
11 in [organized, individual or team sports, athletic games or <--
12 recreational sport activity.] engages in an activity associated <--
13 with exercise, sports, recreation or a vocation that requires a
14 level of strength, endurance, flexibility, range of motion,
15 speed or agility. ANY OF THE FOLLOWING: <--
16 (1) AN INDIVIDUAL OR TEAM SPORT.
17 (2) AN ATHLETIC COMPETITION.
18 (3) A PERFORMING ART.
19 (4) A RECREATIONAL ACTIVITY.
20 (5) A MILITARY EXERCISE.

22 Section 2. The provisions of 49 Pa. Code Ch. 25 Subch. M are
23 abrogated insofar as they are inconsistent with the amendment of
24 the definitions of "athletic training services" and "physically
25 active person" in section 2 of the act.
26 Section 3. This act shall take effect immediately.
