AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, in other required equipment, providing for vehicle
3 doors and further providing for restraint systems.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 75 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 4538. Vehicle doors.
9 (a) Specifications.--
10 (1) Except as otherwise provided and notwithstanding the
11 provisions of section 4107 (relating to unlawful activities),
12 a vehicle shall be equipped with doors of a type used as
13 original equipment. The doors shall open and close securely
14 unless the vehicle has been manufactured or modified to the
15 extent that there is no roof or side.
16 (2) If a vehicle is designed by the manufacturer with
17 removable doors for off-road use or customization, the
18 vehicle may be operated on highways of this Commonwealth with
1 its doors removed or nonoriginal equipment manufacturer
2 doors, provided that the vehicle has two properly functioning
3 side mirrors.
4 (b) No violation of regulation.--As provided in this
5 section, a vehicle with its doors removed or equipped with
6 nonoriginal equipment manufacturer doors at the time of a safety
7 inspection shall not be in violation of 67 Pa. Code § 175.77(f)
8 (relating to vehicle equipment and inspection).
9 (c) Definition.--As used in this section, the term
10 "nonoriginal equipment manufacturer door" shall mean a vehicle
11 door that is not originally equipped by the manufacturer,
12 including a tube door, half door or net door.
13 Section 2. Section 4581(a)(2) of Title 75 is amended by
14 adding subparagraphs to read:
15 § 4581. Restraint systems.
16 (a) Occupant protection.--

19 (ii.1) The driver and each occupant of a vehicle
20 operating without doors or nonoriginal equipment
21 manufacturer doors, as defined under section 4538(c)
22 (relating to vehicle doors) shall wear a properly
23 adjusted and fastened safety seat belt system at all
24 times when the vehicle is operating on a highway in this
25 Commonwealth.
26 (ii.2) A vehicle without doors shall not be driven
27 at any speed if an individual under 16 years of age is a
28 passenger in the vehicle.

30 Section 3. All regulations and parts of regulations are

1 abrogated to the extent of any inconsistency with the provisions
2 of this act.
3 Section 4. This act shall take effect in 180 days.
