AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in professional employees, providing
6 for National Guard or Reserve parent student support.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 1184. National Guard or Reserve Parent Student
13 Support.--(a) Notwithstanding any other provision of law, a
14 student who is a child of a member of the National Guard or <--
15 Reserve shall be afforded the same rights as a COMPACT student <--
16 of an active duty military family under the act of February 2,
17 2012 (P.L.42, No.6), known as the Interstate Compact on
18 Educational Opportunity for Military Children Act, if a parent
19 of the student is required to move to perform the parent's
1 responsibilities in the service of the National Guard or Reserve
2 resulting in the student having to transfer from a public school
3 in one state to a public school in another state LOCATED IN THIS <--
4 COMMONWEALTH.
5 (B) NOTHING UNDER THIS SECTION SHALL BE CONSTRUED TO AMEND <--
6 THE INTERSTATE COMPACT ON EDUCATIONAL OPPORTUNITY FOR MILITARY
7 CHILDREN UNDER SECTION 2 OF THE INTERSTATE COMPACT ON
8 EDUCATIONAL OPPORTUNITY FOR MILITARY CHILDREN ACT.
9 (C) THIS SECTION SHALL ONLY APPLY TO AN ACTION TAKEN OR TO
10 BE TAKEN BY AN ENTITY LOCATED IN THIS COMMONWEALTH, THAT AFFECTS
11 THE RIGHTS OF A STUDENT DESCRIBED UNDER SUBSECTION (A).
12 (b) (D) As used in this section, the following words and <--
13 phrases shall have the meanings given to them in this subsection
14 unless the context clearly indicates otherwise:
15 "COMPACT STUDENT." A STUDENT AS DEFINED UNDER THE INTERSTATE <--
16 COMPACT ON EDUCATIONAL OPPORTUNITY FOR MILITARY CHILDREN.
17 "Public school." As the term "public school entity" is <--
18 defined in section 1183. IF THE TERM REFERS TO A PUBLIC SCHOOL <--
19 LOCATED IN THIS COMMONWEALTH, THE TERM SHALL HAVE THE SAME
20 MEANING AS THE TERM "PUBLIC SCHOOL ENTITY" IN SECTION 1183.
21 "Student." A child of a member of the National Guard or
22 Reserve for whom the child's public school receives public
23 funding and who is formally enrolled in kindergarten through <--
24 twelfth grade.
25 Section 2. This act shall take effect in 60 days.
