AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in terms and courses of study,
6 providing for online curriculum availability.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 1529. Online Curriculum Availability.--(a) For the <--
13 2022-2023 school year and each school year thereafter, a school
14 entity shall post all curriculum, including academic standards
15 to be achieved, instructional materials, assessment techniques
16 and course syllabus for each instructional course offered by the
1 school entity on its publicly accessible Internet website and
2 update the curriculum information each time new or revised
3 curriculum is used by the school entity no later than thirty
4 (30) business days after the new or revised curriculum is
5 approved. The information provided by the school entity under
6 this section shall include an Internet link or title for every
7 textbook used by the school entity. BEGINNING WITH THE 2022-2023 <--
8 SCHOOL YEAR AND EACH SCHOOL YEAR THEREAFTER, A SCHOOL ENTITY
9 SHALL POST AN INTERNET LINK OR TITLE FOR EVERY TEXTBOOK USED BY
10 THE SCHOOL ENTITY, A COURSE SYLLABUS OR A WRITTEN SUMMARY OF
11 EACH INSTRUCTIONAL COURSE AND THE STATE ACADEMIC STANDARDS FOR
12 EACH INSTRUCTIONAL COURSE OFFERED BY THE SCHOOL ENTITY ON ITS
13 PUBLICLY ACCESSIBLE INTERNET WEBSITE. THE INFORMATION SHALL BE
14 UPDATED NO LATER THAN THIRTY (30) BUSINESS DAYS AFTER EACH TIME
15 THE LIST OF TEXTBOOKS, SYLLABI, COURSE DESCRIPTIONS OR STATE
16 ACADEMIC STANDARDS USED BY THE SCHOOL ENTITY IS REVISED.
17 (b) The chief school administrator or a designee shall be
18 responsible for implementing the requirements under subsection
19 (a).
20 (C) IN NO CASE SHALL THE REQUIREMENTS OF THIS SECTION BE <--
21 CONSTRUED TO REQUIRE A SCHOOL ENTITY TO VIOLATE THE COPYRIGHT,
22 TRADEMARK OR OTHER INTELLECTUAL PROPERTY RIGHT OF THE CREATOR OR
23 OWNER OF THE CURRICULUM.
24 (c) (D) As used in this section, the following words and <--
25 phrases shall have the meanings given to them in this subsection
26 unless the context clearly indicates otherwise:
27 "CHIEF SCHOOL ADMINISTRATOR." THE SUPERINTENDENT OF A SCHOOL <--
28 DISTRICT, ADMINISTRATIVE DIRECTOR OF AN AREA CAREER AND
29 TECHNICAL SCHOOL, EXECUTIVE DIRECTOR OF AN INTERMEDIATE UNIT OR
30 CHIEF EXECUTIVE OFFICER OF A CHARTER SCHOOL, CYBER CHARTER

1 SCHOOL OR REGIONAL CHARTER SCHOOL.
2 "School entity." A school district, intermediate unit, area
3 career and technical school, charter school, cyber charter
4 school or regional charter school.
5 Section 2. This act shall take effect in 60 days.
