Digest: The Act directs the court to enter an order prohibiting gun possession by a person charged with some drug possession crimes. Directs the court to enter an order, at the first appearance on a charge of misdemeanor unlawful possession of a controlled substance, prohibiting the charged person from possessing a firearm. Specifies a process for surrendering firearms and the return of firearms. Specifies the circumstances when the court must terminate the order. Provides that possession of a firearm by the prohibited person is punishable by a maximum of 364 days' imprisonment, a $6,250 fine, or both.
Requires that deflection programs, including those receiving grant funding, require participants to transfer all firearms to a law enforcement agency, a gun dealer or a third party until the program is completed.
Declares an emergency, effective on passage.
