This bill amends Section 1403 of Title 20 of the Oklahoma Statutes, which pertains to the disqualification of judges. It establishes a new process for parties to request a judge's disqualification based on a good-faith belief that the judge is disqualified. The requesting party must first make an in-camera request to the judge, and if denied, they can file a written motion for disqualification within ten days of the denial, provided it is not less than ten days before the trial. The judge is required to rule on this motion within fifteen days.
Additionally, the bill allows for the review of a denied disqualification motion by the chief judge of the county or, if the chief judge is the subject of the disqualification, by the presiding judge of the administrative district. An application for rehearing can be filed within five days of an adverse ruling, and the rehearing must be conducted within thirty days. If the rehearing also results in an adverse ruling, the party may seek a mandamus order within five days. The bill is set to take effect on November 1, 2026.
