It establishes that no legal action or recovery can be pursued against the state, cities, towns, or counties that benefit from a public trust due to the housing of federal inmates or inmates from other states in facilities operated by private prison contractors. Additionally, if a public trust that serves a city, town, or county houses such inmates, the immunity provided by the Governmental Tort Claims Act will not apply to that trust.

Furthermore, the bill introduces a provision that limits any allowable legal action or recovery by or on behalf of an inmate in cases where a shared housing facility is used by a combination of state, city, or county entities. In such instances, the action must be directed solely against the specific entity responsible for placing the inmate in the shared facility. The act is set to take effect on November 1, 2026.
