This bill amends existing law regarding discriminatory restrictive covenants in residential additions by requiring county clerks to remove such discriminatory language from recorded plats through municipal ordinance. Specifically, it allows municipalities to amend existing plats to eliminate illegal discriminatory covenants in accordance with the Fair Housing Act. Upon the adoption and recording of an ordinance that amends a recorded plat, municipalities are directed to instruct the county clerk to redact or remove the discriminatory language from the existing plat, without needing approval from property owners of all parcels within the addition.

Additionally, the bill clarifies that any illegal discriminatory restrictive covenant is unenforceable in Oklahoma and declares all such covenants recorded in the state as unlawful, unenforceable, and null and void. The bill ensures that while the discriminatory covenants are severed from the plat, the remainder of the plat remains enforceable and effective. The effective date for this legislation is set for November 1, 2026.
