This bill amends Section 1-321 of Title 63 of the Oklahoma Statutes, which governs the amendment of death certificates. The key change allows for corrections to a death certificate to be made after one year from the date of issuance. Specifically, it introduces a new process whereby an applicant can file a petition with the Administrative Hearing Clerk to seek a final decision from an Administrative Law Judge for any changes, alterations, or amendments to a death certificate that are requested after the one-year period. The applicant must provide clear and convincing evidence that the proposed changes correct an error or misstatement of fact.

Additionally, the bill specifies that beginning April 26, 2022, the biological sex designation on a birth certificate amended under this section must be either male or female, explicitly excluding nonbinary designations. The act is set to take effect on November 1, 2026.
