The proposed bill establishes new requirements for wholesalers of alcoholic beverages who operate online platforms, mandating that they display an updated inventory list of all alcoholic products, including quantities, at least every 24 hours. Non-compliance will be treated as a trade practice violation, leading to penalties such as fines up to $2,000, license suspension, or revocation. The Alcoholic Beverage Laws Enforcement Commission (ABLE) will enforce these regulations and create rules for implementation, including audit protocols.
Additionally, the bill amends the Oklahoma Alcoholic Beverage Control Act by introducing new definitions such as "controlled label" and "private label," which pertain to alcoholic products manufactured under specific agreements. It clarifies that no private or control labels will be approved for sale in the state, with exceptions for charity collaboration beer. The bill also mandates that registered brands disclose the entity holding intellectual property rights and prohibits retailers from offering products exclusively branded under their trademarks. Violations of these provisions will incur significant fines, starting at $10,000 for first offenses, and all alcoholic products must be available for distribution to retail licensees on a nondiscriminatory basis. The bill is set to take effect on November 1, 2026.
