This bill amends Section 1017.3 of Title 56 of the Oklahoma Statutes, which pertains to the eligibility criteria for the ADvantage Waiver Program, a Medicaid home- and community-based service. The amendments include a modification of the age requirement for eligibility from twenty-one (21) years to nineteen (19) years and introduce new criteria that disqualify individuals with an intellectual disability or cognitive impairment, unless specific conditions are met. These conditions allow individuals with cognitive impairments to qualify if they reside in an assisted living center contracted with the Department of Human Services, were already living there when the impairment developed, and have a plan of accommodation executed by the center.

The bill also clarifies that applicants must meet financial qualifications for Medicaid, be sixty-five years of age or older or a physically disabled adult, and be determined to meet the nursing facility institutional level of care. Additionally, it specifies that individuals must reside in their own home, a family member's home, or an assisted living center contracted with the Department of Human Services under the ADvantage Waiver Program. The act is set to take effect on July 1, 2026, and includes an emergency clause for immediate implementation upon passage and approval.
