This bill establishes regulations regarding the use of artificial intelligence (AI) by state agencies in Oklahoma. It defines key terms such as "artificial intelligence," "deepfake," "generative AI," and "state agency," and clarifies that the act applies to all computer systems operated by state agencies, with exceptions for research systems at state-funded institutions and common consumer systems. The bill prohibits certain uses of AI, including cognitive behavioral manipulation, unlawful discrimination, real-time biometric identification for surveillance, and the use of deepfakes for deceptive purposes. Conversely, it allows AI use under specific conditions, such as requiring human review for irreversible decisions and ensuring transparency when generative AI is involved.
State agencies are mandated to review their AI systems for compliance with the new regulations within nine months of the act's effective date, which is set for November 1, 2026. They must remove any prohibited AI systems and modify procedures to align with the act. Additionally, any new AI systems deployed after this date must comply with the established guidelines. The Office of Management and Enterprise Services (OMES) is tasked with reporting annually on the AI systems used by state agencies, detailing which systems were removed for non-compliance and what measures have been taken to ensure adherence to the act.
