This bill amends Section 121 of Title 60 of the Oklahoma Statutes to prohibit foreign government adversaries from owning any mineral interests, including oil and gas, within the state. The term "foreign government adversary" is defined as any government designated by the U.S. Secretary of State as hostile or a Country of Particular Concern. The bill also clarifies that no alien or non-citizen can acquire land in Oklahoma, either directly or indirectly, except under certain conditions, such as engaging in regulated interstate commerce or having a national security agreement with the Committee on Foreign Investment in the United States.
Additionally, the bill mandates that any deed recorded with a county clerk must include an affidavit attesting compliance with the ownership requirements outlined in this section. The affidavit must be executed by the person or entity acquiring the land and must confirm that no funding source is being used in violation of state or federal law. The bill specifies exemptions for certain types of deeds, such as those correcting title defects or made under court orders. The effective date for this act is set for November 1, 2026.
