This bill establishes new regulations regarding the shipment of alcoholic beverages into Oklahoma by out-of-state retailers. It prohibits any person or retailer licensed outside the state from shipping alcoholic beverages to residents of Oklahoma unless permitted by law. The Attorney General is granted the authority to bring civil actions in federal court for violations and to initiate state court proceedings to enforce compliance and impose civil penalties. The Alcoholic Beverage Laws Enforcement Commission is also empowered to conduct investigations, issue cease and desist orders, and assist the Attorney General in these matters. Violators may face civil penalties ranging from $5,000 to $25,000 per violation, or treble damages based on the retail value of the shipped beverages, with each shipment counted as a separate violation.

Additionally, the bill creates the Alcohol Enforcement and Regulatory Revolving Fund within the State Treasury, which will be used to support the legal enforcement actions of the Commission, enhance compliance efforts, and fund public education campaigns against unlawful shipments. The fund will consist of all monies received from penalties imposed under the new regulations and will be continuously available for the Commission's use. The act is set to take effect on July 1, 2026, and includes an emergency clause for immediate implementation upon passage and approval.
