This bill amends Section 3-220 of Title 2 of the Oklahoma Statutes to designate poison hemlock and kudzu as noxious weeds alongside existing noxious weeds such as musk thistle, Scotch thistle, and Canada thistle. The legislation mandates that landowners must treat, control, or eradicate these noxious weeds on their properties to prevent them from going to seed. Additionally, it requires counties and state agencies to manage infestations of these weeds on lands they own or lease. The bill removes the provision for fines for non-compliance, shifting the focus to mandatory treatment and eradication efforts.
The State Department of Agriculture is tasked with inspecting infestations upon written complaint and determining appropriate control methods. The State Board of Agriculture is also required to establish rules regarding infestation categories and to conduct annual surveys of noxious weed infestations. The bill emphasizes the public nuisance status of these weeds and the responsibility of landowners to manage them, while also providing information to assist landowners in compliance. The effective date for this act is set for November 1, 2026.
