The directory is required to be published annually on the Corporation Commission's website in an accessible format. Additionally, electric utilities and water providers serving these data centers must report their respective energy and water usage annually, with the Corporation Commission having the authority to verify these reports and protect proprietary information from public disclosure.
The bill also grants the Corporation Commission rule-making and enforcement authority, allowing it to impose penalties for noncompliance with reporting requirements. It clarifies that while proprietary and critical infrastructure information will be protected, aggregated and non-confidential facility-level data will remain publicly accessible. The act is set to take effect on November 1, 2026.
