This bill amends Section 230.30 of Title 47 of the Oklahoma Statutes, which pertains to the insurance requirements for motor carriers. It introduces a new requirement that motor carriers must only tow trailers that are insured under an active liability insurance policy that meets state or federal financial responsibility standards. Before connecting a power unit to a trailer, carriers are mandated to verify the existence of such insurance through various means, including certificates of insurance or electronic verification systems. Additionally, carriers must retain documentation of this verification for a minimum of two years and make it available to relevant authorities upon request.
The bill also establishes a rebuttable presumption of negligence for motor carriers that connect to or tow uninsured trailers, unless they can demonstrate that they exercised reasonable care in verifying the trailer's insurance. If the presumption is not rebutted, the carrier may be held liable for various costs associated with incidents involving the uninsured trailer, including cleanup and property damage. However, carriers can avoid this presumption if they relied in good faith on valid insurance verification prior to the connection. The bill is set to take effect on November 1, 2026.
