The bill introduces the "Oklahoma Time Taken, Time Back Act," which mandates that courts provide additional visitation or custody access to a parent who has been denied such access due to specific circumstances. These circumstances include investigations by the Department of Human Services, protective or restraining orders, or investigations by other agencies that did not result in findings of abuse or neglect. The court is required to order these additional periods of visitation unless a party can demonstrate good cause against it. The additional visitation must match the type and duration of the originally denied access and must occur within two years of the denial.

Furthermore, the bill stipulates that the individual denied visitation has the right to choose the timing of the additional access, adhering to the outlined requirements. Importantly, the legislation clarifies that it does not create a cause of action against the Department of Human Services nor does it waive sovereign immunity. The act is set to take effect on November 1, 2026.
