This bill establishes new regulations regarding foreign ownership of data centers in Oklahoma. It defines key terms such as "data center," "foreign adversary," and "foreign principal," and prohibits foreign principals from renting, leasing, or holding a controlling interest in data centers within the state. Additionally, it mandates that any foreign principal currently involved with a data center must divest from any rental or lease agreements within 180 days of the bill's effective date. Any existing agreements that conflict with this new law will be deemed invalid unless specified otherwise.
The bill also outlines the responsibilities of the Attorney General in enforcing these provisions. If a foreign principal fails to divest as required, the Attorney General is tasked with initiating legal action in district court. Furthermore, if a data center is found to be held in violation of the law, the district court is authorized to order the foreign principal to divest from any agreements or interests in the data center. The act is set to take effect on November 1, 2026.
