This bill establishes new requirements for individuals or companies intending to construct data centers on unincorporated county land in Oklahoma. It defines a "data center" as a facility primarily containing electronic equipment for processing, storing, and transmitting digital information. The bill mandates that these entities notify the board of county commissioners by submitting a notice of intent, which must be read aloud and recorded in the meeting minutes. Additionally, the notice must be published weekly in a local newspaper for three consecutive weeks. The bill also requires the scheduling of at least three public meetings, spaced two weeks apart, where the plans for the data center will be presented, and questions from the public and commissioners will be addressed.
Furthermore, the board of county commissioners is tasked with certifying that the notification and public meeting requirements have been met before scheduling a vote on the construction of the data center. Notice of this vote must be published for three consecutive weeks in a local newspaper, and the meeting will allow for public comment prior to the vote. Importantly, no vote can occur until all interested members of the public have had the opportunity to express their comments. The bill includes provisions for codification and declares an emergency for its immediate effect upon passage and approval.
