The bill amends the Pretrial Release Act by updating Section 1105.2 of Title 22 of the Oklahoma Statutes. It mandates that judicial districts utilize a validated pretrial risk assessment tool to evaluate defendants before their initial court appearance. This assessment must include information on the defendant's criminal history, community ties, substance abuse history, risk of flight, and potential danger to others, as well as factors such as the nature of the offense and the weight of evidence against the defendant. The court is required to presume the accuracy of this assessment when determining bail or release conditions, although this presumption can be rebutted by the state under specific circumstances.
Additionally, the bill specifies that if a court deviates from the risk assessment's recommendations, it must provide a written explanation detailing the reasons for this deviation. The bill also clarifies that pretrial bail must be set as a numerical dollar amount and outlines procedures for handling cases where a defendant fails to appear in court. Other provisions include the potential use of electronic monitoring devices as a condition of release and the collection of supervision fees. The act is set to take effect on November 1, 2026.
