This bill establishes new regulations aimed at addressing workplace bullying in Oklahoma. It defines key terms such as "employee," "employer," "representative employee," and "workplace bullying," the latter being characterized as severe or pervasive conduct that creates a toxic work environment. Employers and representative employees are mandated to implement reasonable measures to prevent and respond to workplace bullying, including timely acknowledgment of complaints, transparent investigation processes, and the creation of written anti-bullying policies. Additionally, the bill prohibits employers from mandating mediation or arbitration for bullying complaints before employees have legal representation, as well as from using nondisclosure agreements related to such complaints.

The bill also provides a framework for enforcement, allowing individuals to bring a private right of action against employers or employees who violate the provisions within three years of the last violation. Remedies for violations include compensatory and punitive damages, injunctive relief, and restorative measures to correct reputational damage. Furthermore, the bill stipulates that the at-fault party must cover the plaintiff's reasonable attorney fees and court costs, while a prevailing employer cannot be awarded such fees. The act is set to take effect on November 1, 2026.
