This bill amends Section 2-211 of Title 14A of the Oklahoma Statutes, which governs sales transactions and the imposition of surcharges for credit card payments. It establishes that sellers may offer discounts to encourage payment via cash, check, or debit card without these discounts being classified as credit service charges, provided they are clearly communicated to all potential buyers. The bill also sets a maximum surcharge for credit card transactions at two percent of the total transaction amount or the actual processing cost to the seller, whichever is greater. Additionally, it requires sellers to post clear notices regarding surcharges at points of entry and sale, and to verbally disclose this information for phone transactions.

Furthermore, the bill allows sellers registered as money transmitters to charge different prices based on the mode of transmission for electronic funds transmission services, as long as the price for credit card payments does not exceed that for cash payments. It clarifies definitions for "credit card," "seller," and "surcharge," and specifies that certain educational institutions and municipalities may charge service fees limited to specific processing costs. The act is set to take effect on November 1, 2026.
