This bill amends Section 2-102 of the Oklahoma Alcoholic Beverage Control Act to expand the capabilities of small brewer licensees. It allows these licensees to manufacture, bottle, package, and store a limited amount of spirits—specifically, up to one thousand gallons per calendar year. The bill stipulates that small brewers may sell distilled spirits only to licensed wholesalers and manufacturers within the state, and to qualified persons outside the state. Additionally, small brewers are permitted to purchase spirits from licensed distillers and rectifiers in Oklahoma and import spirits for manufacturing purposes, provided they comply with federal laws and regulations.

To engage in the production of spirits, small brewers must obtain a Distilled Spirits Plant (DSP) permit from the Alcohol and Tobacco Tax and Trade Bureau (TTB) and file this permit with the ABLE Commission. The bill also includes provisions for small brewers to continue selling beer and cider, serve samples, and host off-site events, while ensuring that they adhere to existing regulations regarding the sale and distribution of alcoholic beverages. The effective date for this act is set for November 1, 2026.
