This bill amends existing laws related to municipal solid waste management systems and the Plastic Container Labeling Act in Oklahoma. It authorizes incorporated cities and towns to establish, operate, and maintain solid waste management systems, allowing them to levy and collect narrowly tailored fees to offset the costs associated with these systems. The bill specifies that these fees must be just, reasonable, and equitable, and can be based on the quantity or character of solid waste generated. Additionally, municipalities are empowered to adopt ordinances establishing a solid waste mitigation fee aimed at addressing the impacts of retail delivery and single-use products, with the revenue generated to be used solely for solid waste management purposes.
Furthermore, the bill modifies the definition of "auxiliary container" and introduces a new definition for "plastic," while also clarifying that political subdivisions are not prohibited from enacting regulations aimed at reducing plastic waste and promoting recycling efforts. It allows for the implementation of ordinances that address the environmental impacts of auxiliary or plastic container waste. The act is set to take effect on November 1, 2026.
