This bill establishes new regulations regarding the use of automated enforcement devices in construction zones in Oklahoma. It defines an "automated enforcement device" as a system that detects speeding violations and captures images of the vehicle, operator, or license plate. The Department of Public Safety and the Department of Transportation are authorized to place these devices at the beginning of construction zones, with a warning sign positioned 100 feet prior to the device. The devices are permitted to capture images only when a driver exceeds the speed limit by more than ten miles per hour.
Additionally, the bill outlines strict guidelines for image retention and usage. Images not used as evidence must be deleted within 15 minutes, while those used as evidence must be deleted within 24 hours of citation resolution. The Department of Public Safety is prohibited from retaining, selling, or transferring images captured by these devices, and they can only be used for capturing images, not for identification or analysis. Calibration of the devices is required every time their position changes, and independent audits of calibration records and image retention must occur biannually. If violations are found during audits, the vendor will face a fine of $1,000 per retained image. The act is set to take effect on November 1, 2026.
