The Vision Plan Contractual Requirements Act establishes new regulations for contracts between vision plan organizations and optometrists in Oklahoma. It defines key terms such as "vision plan organization," "subscriber," and "vision service plan," and prohibits contracts from requiring optometrists to provide services at fees set by the vision plan organization unless those services are covered under the applicable vision service plan. Additionally, the act mandates that all vision service plans must obtain written approval from optometrists and prohibits vision plan organizations from using an optometrist's agreement from one contract to imply approval for another.
Furthermore, the act restricts vision plan organizations from making changes to contract terms without written consent, incentivizing optometrists to use specific services, or incentivizing subscribers to receive care from entities owned by the vision plan organization. It also stipulates that any payments related to overpayments or underpayments must be based on actual amounts rather than extrapolation and requires entities providing vision care services to notify subscribers of any ownership interests held by vision plan organizations. The act is set to take effect on November 1, 2026.
