This bill establishes new regulations regarding the seizure of personal property by municipalities, counties, and the state in Oklahoma. It defines "abandoned" and "unabandoned" property and prohibits the seizure of personal property located on public property unless there is an objectively reasonable belief that the property is abandoned, poses an immediate threat to public health or safety, is evidence of a crime, or is contraband. Before seizing any abandoned property, the respective authority must post written notice indicating the property will be seized within 48 hours. For unabandoned property, verbal notification must be provided to the owner at least 48 and 24 hours prior to removal, and if the property is removed, written notice must be posted detailing where the property will be kept.
Additionally, the bill mandates that any unabandoned personal property removed by municipalities, counties, or the state must be maintained in a secure location for at least 90 days. If the property remains unclaimed after this period, the respective authority may dispose of it, with specific exceptions for important documents such as birth certificates, driver licenses, and unexpired prescription medications, which cannot be disposed of even after the 90-day period. The bill emphasizes the importance of due process in the handling of personal property and declares an emergency for its immediate enactment.
