This bill amends Section 3129 of Title 68 of the Oklahoma Statutes, which governs county resale auctions of real estate. It requires the Oklahoma Health Care Authority (OHCA) to release certain liens upon the request of a county treasurer or municipality for specific purposes. The bill introduces a definition for "nuisance property," which includes properties deemed unmarketable due to excessive liens or environmental issues. It also establishes that properties must be sold for at least two-thirds of their assessed value or the total amount of taxes and costs due, with provisions for municipalities to bid on nuisance properties if they have outstanding liens.

Additionally, the bill updates the process for conducting resale auctions, allowing county treasurers to hold online auctions and specifying that the OHCA must provide a list of properties with liens to potential buyers. The county treasurer is granted discretion regarding nuisance properties, including the option to not bid them off in the name of the county. The bill also clarifies that counties will not be liable for environmental issues that existed prior to their ownership of the property and outlines the conditions under which the county may take remedial actions without incurring civil liability. The act is set to take effect on November 1, 2026.
