The proposed bill, known as the Racing Facility and Racetrack Nuisance Immunity Act, aims to provide legal protections for racing facilities against nuisance claims from property owners within a three-mile radius. It defines a "racing facility" as an area designated for competitive vehicle and motorsport races, including associated structures and grounds. Under this act, property owners cannot bring nuisance actions against a racing facility if the facility's developer obtained all necessary permits and established vested rights before the property owner purchased their property or constructed any buildings within the specified radius.
However, this immunity from nuisance claims is contingent upon the racing facility's compliance with applicable federal, state, and local laws and regulations. If the facility fails to operate in substantial compliance, the liability protection does not apply. The act is set to take effect on November 1, 2026, and includes provisions for noncodification and codification into the Oklahoma Statutes.
