The bill amends the Alzheimer's Dementia and Other Forms of Dementia Special Care Disclosure Act to enhance the disclosure requirements for facilities that provide care for individuals with Alzheimer's and other forms of dementia. It mandates that nursing facilities, residential care facilities, assisted living centers, and similar establishments must disclose specific information about the type of care they provide, using a standardized form developed by the State Department of Health. Notably, the bill introduces a provision that failure to provide this disclosure could lead to investigations by the Attorney General's office and potential liability for fraudulent practices. Additionally, the Department is empowered to cite facilities for discrepancies found during inspections.
The bill also establishes the Alzheimer-Dementia Disclosure Act Advisory Council, which will advise the State Commissioner of Health on the disclosure form and related rules. The Council will consist of nine members with expertise in memory care or consumer representation, ensuring a balanced perspective. Furthermore, facilities that offer specialized memory care must post their disclosure forms on their websites, and the Department will maintain a public website listing these facilities along with their submitted disclosures. The act is set to take effect on November 1, 2025.
