House Bill No. 2262 aims to enhance the transparency and accountability of facilities that provide care for individuals with Alzheimer's dementia and other forms of dementia. The bill amends Section 1-879.2c of the Alzheimer's Dementia and Other Forms of Dementia Special Care Disclosure Act, requiring facilities that market themselves as offering specialized care for dementia patients to disclose specific information about their services. This includes details about the care provided, staff training, resident activities, and the overall philosophy of the facility. Additionally, referral agencies are mandated to provide a disclosure form for each recommended facility to individuals considering placement for their loved ones.
The bill also establishes the Alzheimer-Dementia Disclosure Act Advisory Council, which will advise the State Commissioner of Health on the development of standardized disclosure forms and rules. Facilities are required to submit their disclosure forms to the Department of Health before entering into care agreements and must ensure that the information is accurate and up-to-date. Violations of the act may result in enforcement actions against the offending facilities. Furthermore, the Department will create a website listing all facilities that have complied with the disclosure requirements, making it easier for families to access important information about care options. The act is set to take effect on November 1, 2025.
