This bill amends existing Oklahoma law regarding expert testimony and hearsay to specifically include provisions for artificial intelligence (AI) expert testimony. Under the amended Section 2702, the bill establishes criteria for the admissibility of AI-generated outputs as expert testimony, requiring that the proponent demonstrate the reliability and relevance of the AI output in a manner similar to human expert testimony. The criteria include ensuring that the output helps the trier of fact, is based on sufficient data, and reflects a reliable application of principles and methods.

Additionally, the bill modifies Section 2806 to address the credibility of AI-generated outputs when they are admitted as evidence. It allows for the accuracy of such outputs to be challenged and supported by evidence, similar to how a human declarant's hearsay statement would be treated. The court is also permitted to consider prior inconsistent outputs from the AI system when evaluating the accuracy of the admitted output. The act is set to take effect on November 1, 2025.
