This bill amends existing Oklahoma law regarding expert testimony and hearsay to specifically include provisions for artificial intelligence (AI) expert testimony. Under the amended Section 2702, it establishes criteria for the admissibility of AI-generated outputs as expert testimony, requiring proponents to demonstrate that the output is likely to assist the trier of fact, is based on sufficient data, and reflects reliable application of principles and methods. Additionally, it introduces a new subsection that outlines the necessary conditions for AI outputs to be considered credible in court.

Furthermore, the bill amends Section 2806 to address the credibility of AI-generated outputs when they are admitted as evidence. It allows for the accuracy of such outputs to be challenged and supported by evidence, similar to how human declarants' statements can be scrutinized. The court is also permitted to consider inconsistent outputs from the AI process when evaluating the accuracy of the admitted evidence. The act is set to take effect on November 1, 2025.
