Senate Bill No. 1106 amends the Fair Pay for Construction Act by updating Section 227 of Title 61 of the Oklahoma Statutes. The bill specifies that the act will not apply to certain types of construction, including highway, railroad, and turnpike construction, while adding municipal road construction to the list of exceptions. Additionally, it clarifies that the act does not apply to contracts related to single-family to four-family dwellings and outlines various types of construction activities, such as roads and utilities, that are also excluded from the act's provisions.

Furthermore, the bill establishes that certain contractual provisions are against public policy and therefore void and unenforceable. These include clauses that subject a construction contract to the laws of another state or require dispute resolution to occur outside of Oklahoma, as well as any provisions that alter the rights of contractors and suppliers under the act. The effective date for these changes is set for November 1, 2025.
