Senate Bill No. 1106 amends the Fair Pay for Construction Act by updating Section 227 of Title 61 of the Oklahoma Statutes. The bill specifies that the act will not apply to highway, railroad, or turnpike construction, and adds municipal road construction to the list of exceptions. Additionally, it clarifies that the act does not apply to certain construction contracts related to roads, bridges, utilities, traffic control, drainage, sanitary sewer, or waterline construction, as well as contracts for single- to four-family dwellings.

Furthermore, the bill establishes that certain provisions in construction contracts are against public policy and thus void and unenforceable. These include clauses that subject the contract to the laws of another state or require dispute resolution to occur in another state, as well as clauses that alter the rights of contractors and suppliers under the act. The effective date for this legislation is set for November 1, 2025.
