House Bill No. 1907, known as the Battery Stewardship Act, establishes regulations for the sale and recycling of certain batteries in Oklahoma, effective January 1, 2027. Producers and retailers will be prohibited from selling covered batteries unless they adhere to specific stewardship requirements, which include submitting a battery stewardship plan to the Oklahoma Department of Environmental Quality (DEQ) by June 1, 2026. This plan must detail strategies for collection, recycling, and educational outreach, ensuring that battery collection is free for users and compliant with environmental standards. Producers will also be required to pay an annual fee based on their market share to support the DEQ's program administration.
The bill further mandates public awareness surveys and independent audits of stewardship plans after five years to evaluate their effectiveness and sustainability. It sets recycling efficiency targets for rechargeable and primary batteries and allows for separate collection systems for Business-to-Business (B2B) batteries. The DEQ will oversee the program, including the approval of stewardship plans and maintaining transparency by publishing relevant information online. Additionally, the bill outlines penalties for non-compliance, mechanisms for cost reimbursement for battery collection and recycling, and grants immunity from certain antitrust laws for producers involved in stewardship programs. The act is scheduled to take effect on November 1, 2025.
