Bill No. 1993 amends Section 540A of the Oklahoma Statutes regarding the crime of eluding peace officers. The bill clarifies the scope of unlawful acts related to this offense by updating the language to include specific types of lights that may be used by peace officers, such as "flashing red, blue, and white lights," and outlines the penalties for violations. A first offense remains a misdemeanor, punishable by up to one year in county jail or fines ranging from $100 to $2,000. Subsequent offenses carry increased penalties, with fines between $500 and $5,000.
Additionally, the bill establishes that if a person endangers others while eluding an officer, it constitutes a felony, with penalties including imprisonment in the custody of the Department of Corrections for one to five years and fines between $1,000 and $5,000. If an accident occurs resulting in great bodily injury while eluding an officer, the offender may also face felony charges with similar penalties. The bill is set to take effect on November 1, 2025.
