The bill prohibits health insurance issuers, pharmacy benefits managers, and other third-party payors from discriminating against 340B entities in terms of reimbursement rates, terms, and conditions. Specifically, it ensures that 340B entities are reimbursed at rates equal to those for non-340B entities and prevents additional administrative burdens that could lead to increased costs for these entities. The bill also restricts manufacturers and distributors from interfering with the acquisition and delivery of 340B drugs to authorized pharmacies.

Enforcement of the provisions will be overseen by the Attorney General and the Insurance Commissioner, who will have the authority to impose penalties for violations. The act includes a civil fine structure for non-compliance, ranging from $100 to $10,000 per violation. Additionally, the bill clarifies that it does not conflict with federal law and is designed to be at least as restrictive as existing federal regulations. The act is set to take effect on November 1, 2025.
