Bill No. 1837 amends Section 4001.5 of the Oklahoma Statutes regarding the Achieving a Better Life Experience (ABLE) Program. The bill introduces new legal language that exempts funds from an ABLE account from Medicaid recovery liens and claims in the event of a beneficiary's death. This means that the funds in these accounts will not be subject to any reimbursement proceedings initiated by the Oklahoma Health Care Authority after the beneficiary passes away.
Additionally, the bill clarifies that money and assets in both state and out-of-state ABLE accounts will not be considered when determining eligibility for assistance or benefits from the Temporary Assistance for Needy Families program or any other means-tested public assistance programs. The act is set to take effect on November 1, 2025.
