This bill mandates that fire insurance policies in rural fire protection districts include specific coverage for fire department responses. It requires that residential or dwelling policies provide coverage for fire department responses at a minimum of two percent (2%) of the property value, with a response fee of One Thousand Dollars ($1,000.00) for the first hour and Two Hundred Fifty Dollars ($250.00) for each additional quarter hour. Additionally, the bill allows for the inclusion of costs related to the replacement of Class A firefighting foam used during fire responses. The Insurance Commissioner is tasked with reviewing these rates annually, with potential adjustments based on the Consumer Price Index or another appropriate index.
Furthermore, the bill stipulates that liability coverage in rural fire protection districts must also include fire department responses to motor vehicle accidents, with a response fee of Five Hundred Forty Dollars ($540.00) for the first hour and One Hundred Thirty-five Dollars ($135.00) for each additional quarter hour. If powered rescue equipment is utilized, the total fee will increase by twenty-five percent (25%), and additional charges for absorbent materials may also be applied. Similar to the fire response fees, these rates will be reviewed annually by the Insurance Commissioner. The act is set to take effect on November 1, 2025.
