The State Department of Health is authorized to monitor compliance and take action against hospitals that fail to adhere to these requirements.
The bill also includes provisions that prohibit noncompliant hospitals from initiating collection actions against patients for debts incurred while the hospital is out of compliance. If a hospital is found to be materially noncompliant, it must refund any payments made by patients and may face penalties, including attorney fees and costs. Furthermore, the bill repeals previous sections of the Transparency in Health Care Prices Act, streamlining the legal framework for hospital pricing transparency. The act is set to take effect on November 1, 2025.
