Coverage is applicable in both inpatient and outpatient settings, provided that a licensed physician or advanced practice registered nurse certifies the medical necessity based on specific criteria, such as low birth weight or gestational age. Additionally, the products must meet quality standards set by the Authority's Board.
The bill also stipulates that reimbursement for these products in inpatient settings will be separate from existing hospital payments. The Board is tasked with creating rules for the implementation of this coverage and may adopt interim policies, which must be publicly posted before finalization. The Authority is required to seek any necessary federal approvals to enact these provisions. The act is set to take effect on November 1, 2025.
