The Oklahoma Public Safety and Immigration Enforcement Act establishes a framework for enhanced collaboration between state law enforcement agencies, the Department of Corrections, and federal immigration authorities. Central to this act is the creation of a Secure Interagency Collaboration Platform, which will facilitate real-time data sharing and communication among these entities. The platform will integrate existing databases, implement security measures to protect sensitive information, and provide automated alerts when unauthorized immigrants are identified within the criminal justice system. The Office of Management and Enterprise Services is tasked with overseeing the development and maintenance of this platform and is authorized to promulgate necessary rules.
Under this act, law enforcement agencies are required to report arrests of individuals suspected of being unauthorized immigrants to both the Department of Corrections and federal immigration authorities through the Secure Interagency Collaboration Platform. The Department of Corrections must screen individuals entering state correctional facilities for unauthorized immigration status and notify federal authorities accordingly. Additionally, the act mandates training for participating agencies on the platform's use and establishes administrative penalties for non-compliance. The Department of Corrections and the Office of Management and Enterprise Services are also authorized to seek federal funding to support the act's implementation. The act is set to take effect on July 1, 2025, and includes an emergency clause for immediate enforcement upon passage.
