This bill establishes a new section in the Oklahoma Statutes that defines and prohibits the use of open primaries, also referred to as jungle primaries, in elections conducted by the State Election Board, county election boards, or municipalities. An open primary is defined as a voting system that allows voters to select candidates in a primary election without regard to their party affiliation. The bill explicitly states that any existing or future ordinances that conflict with this prohibition will be deemed void, as will any elections conducted under such a voting system.
Additionally, the bill grants the Secretary of the State Election Board the authority to initiate civil actions in court to seek declaratory or injunctive relief necessary to enforce this prohibition. The effective date for this legislation is set for November 1, 2025.
