Bill No. 786 amends Section 1220 of the Oklahoma Statutes to update regulations regarding the transportation of alcoholic beverages and the consumption of marijuana while operating a motor vehicle. The bill makes it unlawful for any operator to transport or for any passenger to possess alcoholic beverages or low-point beer in a moving vehicle unless they are in an unopened original container. Additionally, the bill introduces a prohibition against consuming marijuana or inhaling secondhand marijuana smoke while driving, and it specifies that no open containers of marijuana are allowed in the passenger area of a vehicle. Violators of these provisions will be charged with a misdemeanor and face increased fines.

Furthermore, the bill raises the special assessment trauma-care fee from $100 to $250 for those convicted of violating the transportation and consumption laws. It also clarifies that the restrictions on transporting alcoholic beverages do not apply to the passenger areas of buses and limousines, although drivers of these vehicles are still prohibited from consuming or possessing intoxicating beverages. The bill prohibits local governments from enacting their own regulations regarding the consumption or serving of alcoholic beverages in buses or limousines. The act is set to take effect on November 1, 2025.
