The bill amends Section 1220 of Title 21 of the Oklahoma Statutes, which pertains to the transportation of alcoholic beverages and the consumption of marijuana while operating a motor vehicle. It establishes that it is unlawful for any operator to knowingly transport or for any passenger to possess alcoholic beverages or low-point beer in a moving vehicle, unless the beverage is in its original, unopened container stored in the rear compartment of the vehicle. Additionally, the bill introduces a prohibition against consuming marijuana or inhaling secondhand marijuana smoke while driving, and it specifies that no open containers of marijuana are allowed in the passenger area of a vehicle.

Furthermore, the bill increases the special assessment trauma-care fee for violations from $100 to $250, which will be deposited into the Trauma Care Assistance Revolving Fund. It clarifies that the restrictions on open containers do not apply to the passenger areas of buses and limousines, although drivers of these vehicles are still prohibited from consuming or possessing intoxicating beverages. The bill also prevents local governments from enacting regulations regarding the consumption or serving of alcoholic beverages in buses or limousines. The effective date for this legislation is set for November 1, 2025.
